Capption LLC (“Capption” or the “Company”) is committed to protecting your personal privacy. This Privacy Policy defines how we collect, handle, use, share, and protect information about you and explains our practices for collecting, using, maintaining, protecting, and disclosing that information.

This Privacy Policy applies to information we collect or is submitted to us through:

  • Our Android and iOS Mobile Apps
  • Our iOS App Clip
  • Our Administrative Interface
  • Our Website, capption.com, including all related sites and microsites (the “Website”).
  • Social Media, such as Facebook, Instagram, LinkedIn, and Twitter (collectively, “Social Media”).
  • Email and similar electronic messages, except for personal messages sent to our clients.
  • Interactions with advertising and applications on third-party websites and services, as long as they include links to this Privacy Policy.

The Website, Social Media, email and similar electronic messages, and advertising and applications on third-party websites as described above shall be referred to collectively in this Privacy Policy as the “Sites”. The Mobile Apps iOS App Clip, and Administrative Interface shall be referred to collectively as the “Service”.

This Privacy Policy applies to Capption “profiles” on social media sites which are comprised of the intellectual property of Capption, but does not govern information gathered, accessed, or stored directly by social media hosting sites like Twitter, Facebook, or Instagram, all of which have their own privacy statements or policies. Capption encourages you to review the privacy policies for social media hosting sites if you use such sites.

This Privacy Policy does not apply to information collected by:

  • Capption either offline or through any other means.
  • Any third party, including through any application, content, or advertising that may link to or be accessible from or on the Website or Social Media.

All Personal Information (as that term is defined below) that you provide to Capption through our Website or Social Media is voluntary. Should you submit Personal Information, you agree that we may keep a record of that Personal Information, subject to this Privacy Policy. You also agree that if you choose not to provide all required information, you may limit or hinder Capption’s ability to process said information for your requested purpose. If you do not agree to both this Privacy Policy and Capption’s Website Terms and Conditions, you must immediately terminate your use of the Sites.

What information do we collect?

Capption does not generate revenue from surveillance and strives to collect as little personal information as possible. In the course of providing and improving our products and services, we collect your personal information only for the purposes described in this Privacy Notice. The following are the types of personal information that we collect:

Information that you provide

When you enroll in Capption’s Services, place an order, contact us by using the Sites, or otherwise use the Service, you may provide some or all of the following information:

  • Administrative accounts and profiles. Capption leverages external third party sign-on services to manage administrative user accounts. Consequently, we may collect your profile photo, phone number, username, and email address associated with the relevant third-party service provider.
  • Customer support activity. When you communicate with our customer service team through customer support emails, tickets, phone calls, application functionality, social media, or any other means, we will collect your communication history with us in a customer service management system as part of our ongoing effort to improve customer service and support.
  • User-generated content. Text, pictures, photos, images, videos, audio, comments, questions, messages, and other content or information that you generate, transmit, or otherwise make available on the Service, as well as associated metadata.
  • Inquiries, promotion, and event participation. We collect marketing information that you actively share with us via our website, contact forms, social media interactions or related promotional systems. In addition, we collect information about your preferences for receiving marketing communications from us as well as your interactions with them.
  • Other data not explicitly listed here. In the future, we may use other data that you provide as described in this Privacy Policy or for any other purpose disclosed to you at the time we collect your information.

Information from third-party sources

We may combine the personal information that we receive from you with personal information that we obtain from other third-party sources, such as:

  • Data providers. Information services and data licensors that provide demographic and other information, which among other purposes help us detect fraud.
  • Marketing partners. Such as joint marketing partners and event sponsors.
  • U.S. public sources. Including government agencies, public records, and other publicly available sources.
  • Third-party services: We may obtain your information from other third-party services, such as:
    • Social media services—From which we may collect information including your username, profile picture, and email address associated with the relevant third-party service provider, if you choose to register or log in on the Service using said third-party service.
    • Logistics service providers—To effectively complete order fulfillment of physical items like NFC tags or printed materials, we will obtain your logistics information, such as delivery progress and delivery address, and relay it to relevant providers.

Information collected automatically

To enhance your experience with our services and support the other purposes for which we collect personal information, we, our service providers, and our business partners may automatically record information about you, your computer, or mobile device and your interactions with the Service, our communications, and other online services over time, such as:

  • Site usage analytics. We collect information about your interactions with the Sites, including the pages you view, time spent on page, the source from which you arrived at the page, your interactions with the page, whether you opened our emails, and whether you clicked the links within our emails.
  • Location data. Our Sites collect your approximate location data (e.g. IP address).
  • Device data. Capption does not expose or sell user data to third-party information and marketing services. Capption’s Mobile Application and Administrative Interfaces do collect usage information or analytics, including device model, Capption(s) scanned, crashes, operating system information, language settings, relevant unique identifiers, information about the device you use to access the Service, and related usage events.
  • Service usage analytics. We collect information about your interactions with the Service, including the content you view, the duration spent on said content, the source from which you arrived at the content, your interactions with the content, and your interactions with the Service interface(s).
  • No PID or advertising IDs from Mobile App use. Capption does not collect advertising IDs or other Personal Identifiable Data (PID) from Mobile Application users. The only unique Capption IDs are generated when you install the Capption Mobile Application and when you activate a session by using the Mobile Application. We share this Capption access data with purveying institutions to provide them a visitor count, usage profile, and exhibit interest profile based on aggregate data from their insitution.

How and why we use your information

We use the personal information that we collect for various purposes, including to develop, improve, support, and provide the Service, allowing you to use its features while fulfilling and enforcing our Terms of Use. We may use your personal information for the following purposes:

  • Create and maintain your account. We use the personal information collected from third-party sign-on services to create and maintain your administrative user profile on the Service and enable the Service’s account security features (e.g. two-factor authentication, authenticator codes, or sending security codes via email or SMS).
  • Cookies and related technologies. We use cookies and similar technologies on our Sites and Administrative Interface to measure and analyze how you use the Service, including the pages you view and how you interact with the content. Cookies and similar technologies are also used to enhance your experience with the Service. Web beacons are very small images or pieces of data embedded in an image, also known as “pixel tags”, “tracking pixels”, or “clear GIFs”, that recognize cookies, the time and date the page was viewed, a description of the page on which the pixel tag was placed, and similar information from your computer or device. Some of these tools may enable us or third parties to collect information about how you act with our websites over time. If you’d like to disable cookies, your browser will allow you to do so.
  • Orders and delivery of products and services. We use your customer information to receive and process orders, deliver products and services, process payments, and communicate with you regarding orders, products and services, and promotional offers.
  • Improve and optimize services and troubleshooting. We use your analytic history information to optimize features, analyze performance metrics, fix errors, and improve the Service and our business. As part of these activities, we may create aggregated, deidentified data based on the information we collect.
  • Deidentified information. Capption does not capture personally-identifiable data from Mobile App users. For Site and Administrative Interface users, we may deidentify your information such that it cannot reasonably be used to infer information about you or otherwise be linked to you, and we may use such deidentified information for any purpose. To the extent we possess or process any deidentified information, we will not attempt to re-identify the information.
  • Communicate with you and provide customer support. For Site and Administrative Interface users, we use your personal information to communicate with you (e.g. announcements, updates, security alerts, support, and administrative messages) and provide customer support for your requests, questions, and feedback.
  • Promotions and events. We may use your customer profile information to identify your institiution in related promotions and events.
  • Marketing. Our Sites and Administrative Interface may collect and use your personal information for marketing purposes which we may use to send you direct marketing communications. You may opt out of our marketing communications as described in the “Your Controls and Choices” section below.
  • Interest-based advertising. For Site visitors, we, our service providers, and our third-party advertising partners may collect and use your personal information for interest-based advertising purposes. Capption’s Mobile Application and Administrative Interface do not collect information used for interest-based advertising.
  • Fraud prevention and security. For Administrative Interface users, we may use your personal information to prevent, detect, investigate, and respond to fraud, unauthorized access to or use of the Service, violations of the Terms of Use and Policies, or other misconduct.
  • Compliance and legal obligations. We may use your personal information for compliance purposes and to comply with U.S. law, including any applicable laws, lawful requests, and legal processes (e.g. responding to subpoenas or requests from U.S. government authorities); to protect our, yours, and other users’ rights, privacy, safety, or property (including introducing and defending legal claims); audit internal processes to ensure compliance with U.S. legal and contractual requirements and our internal policies; enforce the terms and conditions that govern the Service; prevent, identify, investigate, and deter fraudulent, harmful, unauthorized, unethical, or illegal activities, including cyberattacks and identity theft. We we may ask for your consent to collect, use, or share your personal information, where required by U.S. law.

How and why we share your information

Capption does not sell your personal or business information. For customers, we may share your business information with the following parties for the purpose of providing you with better services, fulfilling your orders, marketing communications, protecting your rights, and/or complying with U.S. legal requirements:

  • Fulfillment providers. For the purpose of order fulfillment, we may share your business information related to order fulfillment, such as shipping address, contact information, with Capption’s fulfillment partners. Unrelated personal information will not be shared. These subsidiaries and affiliates either follow the same practices described in this Privacy Policy or follow practices at least as protective as those described in this Privacy Policy.
  • Service providers. Third parties that provide services on our behalf or help us operate the Service or our business (such as hosting, information technology, customer support, email delivery, order fulfillment and delivery, marketing, consumer research and website analytics). These third-party service providers have only access to personal information needed to perform their functions and services, but shall not use such information for other purposes.
  • Payment processors. Any payment card information you use to make a purchase on the Service is collected and processed by our payment processors.
  • Advertising and analytics partners. For website visitors, third-party advertising, marketing, and analytics systems may obtain visit information from you.
  • Third parties designated by you. We may share your personal data with third parties where you have instructed us or provided your consent to do so, such as information shared with third party authentication providers. We may share the personal information required for the services you request with third parties designated by you. Please be aware that when you use third-party sites or services, their own terms and privacy policies will govern your use of those sites or services.
  • Business and marketing partners. Site visitor and Administrative Interface users may provide data used by third parties with whom we co-sponsor events or promotions with whom we jointly offer products or services.
  • Professional advisors, U.S. authorities, and U.S. regulators. We may share your information with our professional advisors (e.g. lawyers, auditors, bankers and insurers), in response to legal processes (e.g. responding to subpoenas or requests from U.S. law enforcement requests); and with other parties in order to enforce our agreements or policies, protect the rights, property and safety of Capption, users and others, and to detect, prevent and address actual or suspected fraud, violations of Capption’s Terms of Use, other illegal activities, security issues or when it’s required by law.
  • Business transferees. Acquirers and other relevant participants in business transactions (or negotiations of or due diligence for such transactions) involving a corporate divestiture, merger, consolidation, acquisition, reorganization, sale, or other disposition of all or any portion of the business or assets of, or equity interests in Capption.

Your controls and choices

We provide you the ability to exercise certain controls and choices regarding our collection, use and sharing of your information. In accordance with applicable law, your controls and choices may include:

  • Rights to access, delete, and correct your personal information. You may have the right to access, delete, or correct your personal information in addition to other rights under applicable US privacy laws. Please see the US Privacy Notice Addendum for US Residents for more information.
  • Opt-out from marketing communications. Customers and website visitors may preferences or opt-out of marketing communications. To do so, you may follow the unsubscribe options at the bottom of each email.
  • Change settings for cookies and similar technologies. To remove or reject cookies and similar technologies, follow the instructions in your browser settings. Browsers typically accept cookies by default until you change your settings. Note that disabling cookies may cause some web and administrative features to not work properly.
  • Links to third-party platforms. The Service may contain links to websites, mobile applications, and other online services operated by third parties. In addition, our content may be integrated into web pages or other online services that are not associated with us. If you choose to connect to the Service through your social media account or another third-party platform, you may be able to use your settings in your account with that platform to limit the information we receive from it. We do not control websites, mobile applications or online services operated by third parties, and we are not responsible for their actions. Please read the privacy policies of the other websites, mobile applications and online services you use. If you revoke our ability to access information from a third-party platform, that may cease our ability to provide Services, and your revocation will not apply to information that we have already received from that third party.
  • Do Not Track. Your browser may deliver a Do Not Track header or similar signal to this Website. Because of the changing state of technology and variance in standards within the technology and marketing industries regarding the meaning of Do Not Track signals, we currently do not guarantee that we will honor Do Not Track signals.
  • Declining to provide information. We need to collect personal information to provide administrative and fulfillment Services. If you do not provide the information we identify as required or mandatory, we may not be able to provide those services.

Notice to California residents

These disclosures for California residents apply only to individuals who reside in California. The California Consumer Privacy Act of 2018 (“CCPA”) and California Privacy Rights Act (“CPRA”) may provide additional rights to know, delete and opt out, and may require some applicable businesses collecting or disclosing Personal Information to provide notice of rights California residents may exercise. By voluntarily providing notice of and explaining some of these rights, Capption in no way acknowledges or consents to being subject to either the CCPA or CPRA, and expressly disclaims applicability of CCPA and/or CPRA to its business based on small business exemptions to both laws.

Notice of Collection and Non-Collection

What California allows us to collect. Capption may collect or may have collected information corresponding to the following categories of information enumerated in the CCPA.

  • Identifiers, including name, address, email address, account name, Social Security Number, IP address – and an ID number assigned to your account.
  • Customer records, phone number, billing address, credit or debit card information, employment or education information.
  • Demographic information, such as your age or gender. This category includes pieces of Personal Information that also qualify as protected classification characteristics under other pre-existing California or federal laws.
  • Analytics and advertising, including purchases and engagement with our services.
  • Internet activity, including history of visiting and interacting with our service, browser type, browser language and other information collected automatically.
  • Geolocation data, including location enabled services such as Wi-Fi and GPS.
  • Inferences, including information about your interests and preferences.

Collection and disclosure. Capption will not intentionally collect Sensitive Personal Information as enumerated by the CRPA, including biometric data, social security numbers, driver’s license numbers, geolocation data, race, ethnicity, religious or philosophical beliefs, union membership, content of nonpublic communications, genetic data, or sex life or sexual orientation information.

Capption may collect and use some categories of Personal Information as above for the business purposes described in this Privacy Policy. Capption will not intentionally collect or use any of the categories of Personal Information as above. Capption does not sell information. However, to the extent Capption “sells” information as that term is defined under the CCPA, if required, we will comply with applicable law as to such activity.

Capption may disclose the following categories of information for commercial purposes: Commercial Information; Demographic Data; Location Data; Identifiers; Inferences; and Internet activity. Capption may use and/or partner with different types of entities to assist with our daily operations and manage our Sites.

Right to know and delete. If you are a California resident, you may have the right to know certain information about our data practices in the preceding 12 months. You may request the following from us:

  • The categories of Personal Information we have collected about you;
  • The categories of sources from which the Personal Information was collected;
  • The categories of Personal Information about you we disclosed for a business purpose or sold;
  • The categories of third parties to whom the Personal Information was disclosed or sold;
  • The business or commercial purpose for collecting or selling the Personal Information; and
  • The specific pieces of Personal Information we have collected about you.
  • In addition, you have the right to delete the Personal Information we have collected from you. However, this is not an absolute right and we may have legal grounds for keeping such data.

To exercise any of these rights, please submit a request to Capption at hello@capption.com. In the request, please specify which right you are seeking to exercise and the scope of the request. Capption will confirm receipt of your request within 10 days. We may require specific information from you to help us verify your identity and process your request. If we are unable to verify your identity or determine that we are not bound by law to respond to your request(s), we may deny your request(s).

Authorized agent. You can designate an authorized agent to submit requests on your behalf. However, we will require written proof of the agent’s permission to do so and verify your identity directly.

Right to non-discrimination. You have the right to non-discriminatory treatment by us, should you choose to exercise any of your rights.

Shine the light. Site users who are residents of California may request: (i) a list of the categories of Personal Information disclosed by us to third parties during the immediately preceding calendar year for those third parties’ own direct marketing purposes, and (ii) a list of the categories of third parties to whom we disclosed such information. To submit a request, please contact us at hello\@capption.com. Requests must include “California Shine the Light Request” in the subject line and include your name, street address, city, state, and ZIP code. We may require additional information from you to allow us to verify your identity and if we determine that we are not bound by law to respond to your request(s), we may deny your request(s). Please note that Capption is not required to respond to requests made by means other than through the provided email address or mail address (below). We may decline to process any requests that are frivolous/vexatious, jeopardize the privacy of others, are extremely impractical, or for which access is not otherwise required by law. We may also decline aspects of deletion or data access requests if we believe doing so would undermine our legitimate use of data for anti-fraud and security purposes.

Notice to European Union users

Capption operates in the United States. If you are subject to the European Union General Data Protection Regulation 2016/679 of 2018 (“GDPR”) (if you are a resident of a jurisdiction subject to GDPR protections and are also using the Sites within a jurisdiction subject to GDPR protections) and provide information to us, that information will be transferred out of the European Union to the United States. By providing Personal Information to us, you are consenting to its storage and use as described in this Privacy Policy. If you have a complaint, you may file it with your local data protection supervisory authority.

You may have a right under GDPR to: (i) withdraw consent; (ii) request your Personal Information previously collected by Capption; or (iii) pause any data processing relating to your Personal Information in the event you object to it. If you are subject to GDPR and would like to exercise any of the options listed in this section, please contact Capption at hello\@capption.com.

Children under the age of 18

Because we care about the safety and privacy of children online, we comply with the Children’s Online Privacy Protection Act of 1998 (“COPPA”), as amended. Capption does not sell products or services for purchase by children. If you are under 18, you may not purchase or administer Capption services and/or products without the written consent of a parent or guardian. Capption does not knowingly collect personal information from children under the age of 13. Similarly, Capption complies with the provisions in GDPR regarding privacy of children and does not solicit information of any kind from children under 16 in jurisdictions subject to GDPR.

It is possible that by fraud or deception we may receive information pertaining to children under 13, or equivalent minimum age depending on jurisdiction (under 16 in the case of jurisdictions subject to GDPR, for example). If we are notified of this, as soon as we verify the information, we will immediately delete the information from our servers. If you want to notify us of our unauthorized receipt of information by children under 13, or equivalent minimum age depending on jurisdiction, please do so by sending an email to Capption at hello\@capption.com.

Data security and retention

Capption takes privacy and security seriously enough that we collect very little data from you.

The Capption Mobile App does not collect user data, just usage data. That usage data is comprised of which Capptions were accessed, where, and in what language. Your access history lives on your device and is never shared. App analytics data was never identified and exists in the analytics platform’s database.

The Capption Website and Administrative Interface use technical and administrative measures to help protect your personal information from loss, theft, misuse, unauthorized access, disclosure, alteration, and/or destruction. We also follow the Payment Card Industry Data Security Standard (“PCI-DSS”) in handling your credit card information. However, security risk is inherent in all internet and information technologies.

We retain personal and busines information to fulfill the purposes for which we collected it, as well as for the purposes of satisfying any U.S. legal, accounting, or reporting requirements, to establish or defend legal claims, or for fraud prevention purposes. To determine the appropriate retention period for personal information, we may consider factors such as the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements. When we no longer require the personal information we have collected about you, we may either delete it, anonymize it, or isolate it from further processing.

Changes to our Privacy Policy

Capption will post any changes we make to the Privacy Policy on this page, and we will indicate the date the Privacy Policy was last updated at the top of the page. By your continued use of the Services and Sites, you are responsible for periodically checking for changes on our Website and for ensuring we have your up-to-date, active, and functional e-mail address.

Your acceptance of our Privacy Policy

Capption will occasionally update this Privacy Policy to reflect updates to data privacy laws, and company and customer feedback. Capption encourages you to periodically review this Privacy Policy as may be modified from time to time. Your continued use or accessing of the Sites following the posting of changes to this Privacy Policy will be deemed your acceptance of such changes.
